FOPH: Federal Council adopted new ordinance on the activity of insurance intermediaries
14 August 2024 – The Federal Council has adopted the Ordinance on the Regulation of Insurance Intermediary Activities (Verordnung über die Regulierung der Versicherungsvermittlertätigkeit), which will come into effect on 1 September 2024. This ordinance codifies previously voluntary industry standards, including a prohibition on cold calling, the requirement to prepare and sign consultation records and a cap on commissions to intermediaries. Intermediary compensation will be capped at CHF 70 per insured person for mandatory health insurance and 16 monthly premiums per product for supplementary insurance. Previously, these standards applied only to insurers who voluntarily adhered to them. Under the new ordinance, regulatory authorities will now have the authority to intervene in cases of non-compliance. Violations of the new regulations may result in fines of up to CHF 100,000. The new regulations will apply to premiums for 2025 and will therefore affect the next health insurance change period.
