Minimum number of members in a cooperative


According to the unanimous decision of 25 May 2012 of the First Civil Law Division of the Swiss Federal Supreme Court, a cooperative must have at least seven members. If this legal requirement is no longer met and the number of members is not increased to at least seven persons within a specified deadline, the judge must dissolve the cooperative.

Our partner Stephan Neidhardt has successfully obtained this landmark decision for our clients in cooperation with other attorneys from our firm following court proceedings that lasted seven years and were brought before three courts.
