We advise and support clients in the public sector, public companies owned by the Confederation, cantons and municipalities, as well as their partners organised along private-sector lines, on all issues of public law and their interfaces with private law. The particular needs of the public sector and its partners are dealt with by an interdisciplinary team of experienced lawyers, who have been working for many years in the areas of administrative, energy, traffic, healthcare, environmental, tax, public procurement, public building and public procedural law for many years.

Sovereign administrative action is increasingly being replaced by cooperative procedures. We support our clients in negotiation procedures and in the conclusion of administrative agreements, and help them in settling disputes arising under administrative law, as well as in creating public private partnerships (PPPs).

We represent our clients in administrative disputes before cantonal administrative courts, the Federal Administrative Court and the Swiss Federal Supreme Court. Our main focus, however, lies on avoiding litigation.

Public Sector
Introduction

Experts Products & experience

Our key areas of activity are:

  • General administrative law, including personnel law
  • Environmental law, in particular matters of contaminated sites
  • Traffic law, in particular rail transport law
  • Healthcare law, in particular negotiating performance mandates and compensation models as well as procedural enforcement of the right prices or tariffs
  • Energy law, for example in case of disputes regarding tariffs, expert opinions on the application of the Federal Electricity Supply Act, concession proceedings, issues relating to cantonal and municipal legislation, etc.
  • Regulatory law and regulatory measures
  • Tax law, in particular tax litigation
  • Public procurement law, both preparing and executing invitations to tender and appeal proceedings
  • Constitutional law, in particular in connection with the review of cantonal decisions by the Swiss Federal Supreme Court
  • Participation in development of legislative decrees

Public procedural law

Our specialists not only have profound knowledge in the individual fields of law, and extensive experience in litigation in the respective areas - they have also analysed public procedural law in depth, in particular with respect to obtaining, defending against or enforcing interim measures, measures of the administrative penal law, implementing or monitoring investigative measures, etc. We have acquainted the Federal Administrative Court with the instrument of the so-called protective letter, and assess the use of appropriate means and strategies in each individual case.
