Participation of a parent company in settlement discussions leads to consolidation of two separate Swiss Rules proceedings

20 February 2019 – Walder Wyss’s arbitration team members Michael Cartier and Chloé Terrapon acting for a German supplier of industrial plants obtained the consolidation of two separate Swiss Rules arbitration proceedings against two Russian group companies under separate but similar supply agreements on grounds that inter alia the parent company had involved itself in the discussions regarding outstanding payment obligations of both its subsidiaries. The disputes were later settled favorably for Walder Wyss’s client.
