10 juillet 2012 – Federal Supreme Court dismisses appeal of LEGO Systems A/S against MEGA Brands Inc. regarding the validity of LEGO's brick trademarks

With a decision of July 3, 2012, the Swiss Federal Supreme Court dismissed the appeal of LEGO Systems A/S against MEGA Brands Inc. regarding the validity of LEGO's brick trademark. The Court of Commerce of the Canton of Zurich ruled that the three-dimensional trademarks of LEGO (the LEGO brick) are barred from trademark protection because of the functionality of the shape of the trademarks. The Swiss Federal Supreme Court now confirmed this decision. As a result, LEGO’s three-dimensional trademarks have been finally declared null and void in Switzerland after a very long, persistent fight in court.
