7 avril 2020 – In a recent decision the Federal Administrative Court held that article 65b para. 6 KVV is also applicable in the context of the triennial review of drugs. Furthermore, the Federal Supreme Court supported the lower instance in its statement that it is not sufficient for the assumption of therapeutic progress within the meaning of article 65b para. 6 KVV that a drug differs from the predecessor preparation only in the form of dosage. The complaint was rejected.
