Federal Supreme Court, Decision 9C_592/2019 of 25 May 2020
18 juin 2020 – In a recent decision, the Federal Supreme Court held that a weight loss from 140 kg to 65 kg at a height of 175 cm is an unusually large weight loss and thus an anomaly that meets the definition of a disease. The Federal Supreme Court describes the qualification in the lower court, according to which weight loss is a normal physiological process which cannot have any pathological value either per se or in terms of its consequences, as legally unacceptable and comes to the conclusion that the contested decision violates federal law to the extent that it negates the respondent's obligation to perform the surgical correction of excess skin and fat distribution on the thighs.
