Federal Supreme Court, Decision 9C_41/2020 of 17 June 2020
24 septembre 2020 – In a recent decision, the Federal Supreme Court held that a Spitex deployment can no longer be considered economic, even taking into account the legitimate interests of the insured person, if there is a major discrepancy between the costs of a Spitex deployment and those of the stay in a nursing home. Although ambulant care in the present case was qualified as more effective and more appropriate, the Federal Supreme Court classified the total costs of home care of approximately CHF 80,000 per year and a resulting factor of 3.4 compared to the costs of home care as uneconomic. The Federal Supreme Court approved the complaint of the insurer and set aside the decision of the Social Security Court of the Canton of Zurich.
