Federal Supreme Court, Decision 9C_815/2019 of 15 June 2020

8 luglio 2020 – In a recent decision, the Federal Supreme Court held that even in the case of insured persons with a birth defect, the compulsory health insurer must in principle provide benefits only within the framework of the compulsory benefits catalogue of social health insurance. The Hippotherapy-K in dispute, even as a consequence of a birth defect, is not a therapeutic measure in the sense of the exceptional provisions of article 52 para. 2 of the Swiss Federal Law on Health Insurance (KVG) and article 35 of the Health Insurance Ordinance (KVV), as it is not listed in the catalogue of compulsory benefits.
