9 giugno 2022 – In the present case, the Federal Administrative Court had to decide whether the immediate recall of all batches of a medicinal product on the Swiss market ordered by the prior authority, down to the level of the retail trade, and the ordered ban on distribution were lawful. Swissmedic essentially justified the recall on the grounds that there was a considerable risk that users of the medicinal product B. would be exposed to unacceptable levels of contamination. As the recall had already taken place at the time of the ruling, the appeal proceedings were dismissed as irrelevant due to the subsequent loss of the complainant's interest.
