FOEN publishes Enforcement Guidance on Climate-Related Claims under revised UCA

The Federal Office for the Environment (FOEN) has published an Enforcement Aid for Assessing Climate-Related Claims in accordance with the revised Federal Act against Unfair Competition (UCA). This Enforcement Aid defines the legal requirements for climate-related claims (“climate claims”) and, for the first time, provides companies, authorities and other stakeholders with a practical framework to ensure legally compliant communication about climate impact. The Enforcement Aid is intended in particular to promote the consistent application of Article 3(1)(x) UCA.
The Enforcement Aid was developed with the active involvement of Walder Wyss. The team was led by Sylvia Anthamatten (Counsel, Intellectual Property/Competition) and included Isabell Schellhas (Associate, Regulatory), Andreas Hösli (Senior Associate, Corporate / M&A) and Luc Zufferey (Trainee Lawyer, Intellectual Property/Competition).
