Walder Wyss's client was sued in a Swiss Rules arbitration based on a non-signed contract/arbitration clause. Walder Wyss successfully objected to jurisdiction on grounds that neither the statutory nor contractual form requirements were met, and consequently no arbitration agreement was entered into.
