Walder Wyss prevails before the Federal Administrative Court in a matter concerning an account freeze under the Swiss Foreign Illicit Assets Act

The Swiss Federal Council froze the account of a client based on Federal Act on the Freezing and the Restitution of Illicit Assets held by Foreign Politically Exposed Persons (Foreign Illicit Assets Act, FIAA / aka SRVG).

Walder Wyss prevailed before the Federal Administrative Court, which found that the Federal Council had failed to establish the underlying facts to justify the freezing of the account, and had yet to establish that the originating country constituted a failed state as required by SRVG.
