Public Procurement

The Swiss public procurement market accounts for around CHF 40 billion a year and represents a major driving force for the economy. However, the legal foundations of this market are sometimes confusing. Discrepancies abound regarding judicial practice, which results in a lack of legal certainty in specific areas. Walder Wyss helps public procurement offices and suppliers navigate their way through this labyrinth.

We advise on structuring and executing invitations to tender, represent parties before cantonal administrative courts, the Swiss Federal Administrative Court as well as the Swiss Federal Supreme Court, draw up and negotiate procurement contracts, and offer assistance on issues concerning the scope of application of public procurement laws. Our service offerings range from overall responsibility for procurement projects, to advice on particular points, and expert opinions on issues relating to public procurement law.

Our key areas of activity are:

  • Advising public-sector clients and providers in connection with invitations to tender for construction, service and supply contracts
  • Representing parties before administrative courts in connection with disputes over procurement issues
  • Preparing complex descriptions as project manager, from structuring through to award of contract
  • Obtaining legal opinions on issues relating to public procurement law
  • Providing training for public-sector principals and suppliers
  • Editing and negotiating procurement contracts
